CHAPTER 82. BOATING REGULATIONS
CHAPTER EXPIRATION DATE:
Chapter 82, Boating Regulations, expires on January 4, 2015.
§ 13:82-1.7 Speed

(a) No person shall operate a vessel in a manner where the speed and/or wake of the vessel may
cause danger or injury to life or limb or damage to property.

(b) All vessels shall reduce speed to slow speed/no wake when passing:
1. Any marina, pier, dock, wharf or abutment at a distance of 200 feet or less, except on Lake
Hopatcong, in accordance with N.J.A.C. 13:82-3.11;

2. Work barges, platforms or floats while actually engaged in work related activity;
3. Through bridge openings of 400 feet or less;

4. Through lagoons, canals and confined areas of less than 200 feet in width;

5. Vessels not under command;

6. Emergency vessels displaying sequential flashing or rotating blue lights; or

7. Vessels engaged in activities recognized by the Coast Guard displaying rotating or sequential flashing red and yellow lights.

(c) "Slow speed/No wake" as used in this section means the speed at which a vessel moves through the water and is able to maintain minimum headway in relation to the vessel or structure being passed and producing the minimum wake possible.

(d) State Police, on the recommendation of the Commission or on its own initiative, may designate a specific area not included in (b)1 through 6 above as a temporary slow speed/no wake area based on congestion, visibility, safety, or other good cause. All vessels moving through these areas shall reduce their speed to slow speed/no wake within a 200-foot radius of the sign or buoy, in addition to any restriction under (b) above.

(e) No person shall place, anchor, or construct any buoy that states or implies that an area is a "Slow Speed/No Wake" area except as provided in (a) through (d) above. The State Police may remove or have removed any such unauthorized buoy.

Personal watercraft operators are reminded that New Jersey personal watercraft laws have recently changed. The law now states that a person is not permitted to operate a personal watercraft above minimum headway speed within 100 feet of buoys or signs that mark the boundaries of a swimming area, the shoreline, any person in the water, or residential dwelling units.

Additionally, personal watercraft are not permitted to be operated in such a manner so as to make the vessel completely leave the water or otherwise become airborne within 100 feet of another vessel.

Preexisting laws that remain unaffected by the recent changes require that personal watercraft be operated only between sunrise and sunset and during times of good visibility. Personal watercraft are not permitted to be operated within the confines of the Point Pleasant Canal in Ocean County, or the Cape May Canal in Cape May County.

Personal watercraft operators must be at least 16 years of age, and must have a boating safety certificate in their possession.

You are responsible for your wake and any damage it causes! It could dump someone out of his boat, cause someone to fall down the companionway stairs, swamp a bowrider, damage a boat at a dock on the shoreline or harm the environment by eroding the shoreline and much more. When your wake causes damage, it could result in very serious consequences. You are responsible and could be facing fines and lawsuits. Learn how to avoid wake damage.
A Wake is the waves generated in the water by a moving boat. Depending on the size of your boat, the wake you throw can be cavernous and, when it hits the shore, can have the effect of a series of small tidal waves.
Wake zones are posted for two reasons:
1. First, constant wakes can erode a shoreline and cause damage to any boats and docks along that shoreline.
2. Secondly, big wakes can not only be very uncomfortable but very dangerous for oncoming boat traffic--especially if they are smaller than you.
The key is to SLOW DOWN all the way.
Many boaters figure that if they slow down slightly from their planing speed that they are doing the right thing. But, in reality, when you drop just off of plane, you’re drawing a much larger wake than when you were on top. The typical rpm’s on plane is anywhere from 2800 to 4000 rpm where the boat is riding on top of the water. The typical rpm’s that people mistakenly slow down to, is what I call bulldozer speed where you are drawing a huge tidal wave. This rpm varies between 1800 and 2500. For a "no wake" zone, you should be running between 700 and 1500 rpm where the boat is in displacement mode, totally in the water and where the wake is no more than 6" high.
When approaching an inconsiderate boater who is drawing a huge wake, there are several methods of attacking this oncoming hill. In a tight narrow channel or river--a couple of boat lengths away from his wake--steer directly towards the wake so that you will be hitting it at right angles and advance your throttle from idle up to approximately 2500 until you’ve crossed through the wake. Then reduce your throttle back to idle. This approach will give your passengers a smoother crossing and not throw up a lot of wake.
In a wide channel, where you can veer off, you can maintain your idle speed or step it up slightly to 1500 so the boat is a little more solid. Then, traverse his wake at about a 45 degree angle so that your boat is, as I put it, slithering up one side and down the other. His wake is much reduced when you are way off to the side.

Always look behind your boat and check your wake. It is as important as looking forward to make sure you have a clear path. A variation on the old golden rule of "do unto others, as you would have them do unto you", is to "leave a wake behind your boat, that you would want other boats to leave for you."
